RoHS restricts the use of specific hazardous substances in electrical and electronic equipment sold in the European Union. Originally targeting six substances, the directive was expanded under RoHS 2 to include four phthalates, bringing the total to ten restricted substance groups. Who It Applies To
Manufacturers, importers, and distributors of electrical and electronic equipment sold in the EU. RoHS covers 11 product categories - from large household appliances and IT equipment to medical devices and monitoring instruments. If your product uses electricity to function and is sold in the EU, RoHS almost certainly applies.
Key Requirements
RoHS compliance is not a one-time exercise. It requires ongoing substance monitoring, document maintenance, exemption tracking, and supply chain engagement. These are the non-negotiable obligations for any EEE placed on the EU market.
- Maximum Concentration Values (MCVs): Products must not exceed the threshold for any of the ten restricted substances, measured per homogeneous material - not per component or product.
- EU Declaration of Conformity: An EU DoC must be prepared and kept available to market surveillance authorities for the full 10-year retention window.
- Technical Documentation: Full technical documentation - including test reports, supplier declarations, and substance data - must be maintained for 10 years after market placement.
- CE Marking: CE marking is required for all compliant EEE products. Incorrect or unsupported CE marks create liability exposure across the distribution chain.
- Exemption Tracking: Applicable exemptions must be actively monitored. They are time-limited and subject to renewal or withdrawal, and reliance on an expired exemption invalidates compliance.
